Is passing gas a crime?

A West Virginia man, Jose Cruz, was arrested on Monday for driving under the influence.  That same night Cruz ended up charged with battery on a police officer -- for passing gas.

"When police were trying to get fingerprints, police say Cruz moved closer to the officer and passed gas on him," reports WSAZ.  "The investigating officer remarked in the criminal complaint that the odor was very strong."  (Source)
