What Is Spam?
According to the Virginia Supreme Court, the state's anti-spam law is unconstitutional because it violates the First Amendment. Justice G. Steven Agee ruled that Virginia's law prohibits the anonymous transmission of all unsolicited bulk e-mails, including messages that might contain political, religious, and other speech protected by the First Amendment.
This ruling absolves Jeremy Jaynes -- one of the world's most prolific spammers -- who was imprisoned in 2004 and sentanced to 9 years in prison. He sent up to 10 million e-mail messages a day from his home.
Luckily, Jeremy Jaynes won't be back to spamming anytime soon. He will remain in jail for an unrelated seucrities fraud charge.
