Lawsuit Filed Against Obama Claims He's Not Eligible for the Presidency

 

Philip J. Berg, Esquire, of Pennsylvania filed a lawsuit on Thursday seeking a Declaratory Judgement and Injunction that Barack Obama does not meet the qualifications to become President of the United States. In the lawsuit Berg alleges that Obama is not eligible for the presidency because he is not a naturalized citizen, and/or lost his citizenship when he was adopted in Indonesia, and/or has duel citizenship with Kenya and Indonesia.

Berg said that he has filed the suit on behalf of the Democratic Party and citizens of the United States for their best interests. Berg, an attorney with offices in Montgomery County, PA and an active practice in Philadelphia, filed the lawsuit, Berg vs. Obama, Civil Action No. 08-cv-4083, in Federal Court.

That stipulation was in the event of Obama being born OUTSIDE THE US. Whoever looked up that law to begin with, clearly took that particular quote out of context.

Still a citizen, But to run for president, you must be born on US soil and not have any other foreign allegiance (i.e. citizenship) to any other nationality.  It can be argued that Obama does in fact have other allegiances.

They would have looked into his past extensively when they were seeking to nominate him. His mother was a citizen of the US when he was born, and remained one while she lived in Indonesia. If it is a simple matter of renouncing the foreign citizenship, should he even be eligible for foreign citizenship, then that should be easy.-That being said, just being the child of a foreigner does not automatically give you citizenship of that country. It gives you the option of taking citizenship up.

And if you have US parents but are born outside the US you are still an American citizen.

Oh okay thanks... I guess I misunderstood the article. I thought it was suggesting that he was not born in the US. I didn't know about the dual citizenship rule. I don't really follow politics to that extent. :-)

You are partially correct; you do have to be born in the United States; Obama was born in Hawaii.  You also must not have any allegiance to any other nations, by having a dual citizenship it creates an allegiance to another nation.  In Obamas case Kenya and Indonesia (due to addoption)  Obama would have had to officially denounce his citizenship from both Kenya and Indonesia to be eligible to hold office of US president.

I thought you had to be born in America in order to be the president. Isn't that why Arnold Schwarzenegger is not allowed to run? Maybe I'm wrong???

I think if the right people get their hands on this, Obama could be and should be disqualified.   If Obama did not denounce his other citizenships to Kenya or Indonesia prior to receiving the nomination technically he can’t be president.

hmmmm. I've never heard this. This lawsuit was filed on Thursday, eh? Till seeing this poll I hadn't heard anything about it. I hope he's still eligible. Sheesh, the guy's come an awful long way already.

Is Berg going to sue the State of Hawaii? They would have had to be in on it too. How large IS this conspiracy? I'm sorry, but this doesn't seem legit.
