It will not do her any good all these companys like photo developing places have in their terms and conditions that they are not responsible for any information or third party losses while undertaking repairs or services of any computer. As they lost her property they are resposible for replacing it with one of the same or greater value or compensating her the cash value of it. she can sue them for inconvenice ect but the bottom line is she should have kept a backup of all information. If she was in the uk and got £500 ($1000) she would be lucky! I have a friend who repairs laptops he makes people read & sign to the above effect before touching any laptop sold by him or just brought for repair. he also offers to remove & back up hard drive at extra cost but still takes no responsibility for any none hardware losses. good luck to her they will have 10 lawyers will take her 10 years to get anywhere she should take whatever they offer & a new laptop.
She couldve had her bank account stuf n everything else essential and personal who knows she couldve been strippin n the media got to it its really a personal mattter
Not to mention that what BB did would've been better if it was a slap in the face. A lawsuit like this is surely a lesson bound to awaken the long lost "first class customer service" so scarcely found in most any service center these days, regardless of which.
IMO, to the untrained mind and/or the quick-to-judge, $54m might seem an unreasonable figure, but when you take the time to really ponder over what was lost, more importantly compromised, nightmares ranging from ID Theft, to finding pictures of you in lace and leather alongside RuPaul before a drug countered lounge table, costing you your job, potentially your marriage, and defile your social standing for years to come, may justify the steep the 54 mill and then some. Imagine a corporate financeer, who just compromised all of his clients' personal, stock, banking, etc information - she may be finding herself on the other side of the law suit if a client is jeopardized by the data spill. A good lawyer? Can get her $100m for starters plus punitive damages and losses. I'm not all for exploiting the system, but I've been in situations, like ID Theft, that are going 10yrs and strong in my battle to beat - imagine if I had to explain to my boss or kids that wasn't really me with Elvis in lipstick playing strip poker with the Teletubbies in St Patrick's Cathedral. Just ask yourself, how much does your piece of mind cost?
Good for her and I hope she wins. First, the uncaring attitude of Best Buy needs to be corrected - they made a big mistake and should have acknowledged that up front with an apology and a proper compensation - a new laptop and cash for the lost forever files. Since that was too much to ask - they obviously need a wake up call. As for her not backing up her files, who really backs their files daily? Not many of us. Why should she think that a company she trusted would lose or destroy them? From what I've read, it went in for a new power button - nothing to do with the hard drive. $54 mill is too much, yes, but if she sues for $54 mill with luck they'll give her $1mill - and do something about the internal system of both "customer service" and keeping track of customers computers.
recently bought a computer at best buy and i made a payment and they told me they lost a $750.00 payment; that a worst part is that they we not goin to tell me either! I had to go through hell to prove that they lost my money and to get them to reimburst me! So yeah they do deserve it for ripping people off like her, me and other people. And they did not apologize!!!!
The only way to end this horrible lawsuit Epidemic is to initiate a 'Loser Pays' program so that people will stop filing frivilous lawsuits where even if the defendant wins they lose thousands due to court and attorney costs.
make the coorporate bully suffer? oh no no. I'm so sick of sore losers. Best Buy offers good prices and tons of job opportunities. if u have a grievance sue, by all means, that's what the judicial system is here for. but do it not out of spite for the fact that the folks at best buy simply have moe vision than the litttle guy
her point was to get attention for her case so best buy would have to take it seriously, think wed be reading this if she sued for 5 grand?she doesnt expect to get 54 million just a replacement or enough cash for a replacement.
What she's asking for is rediculous. Does she have grounds to sue? Sure, you can sue for anything nowdays. And I know how hard it is when a laptop full of information is lost. HOWEVER! I'm pretty sure BB was willing to replace the laptop. And even if they weren't 54 million is just completely unrealistic
Best Buy clearly BROKE THE LAW regarding ID theft but I have read that the braindead judge she got dismissed the case in May 2008.
no you are
YOU GO RAELYN!!!!
